Terms of Service

These terms are the agreement between you and Perche Creek Studios, LLC, a Missouri limited liability company, for the use of VESTAL.

Accepting these terms

By downloading, opening, or using VESTAL, you agree to these terms. If you do not agree, do not use the app. You must be at least 13 years old to use VESTAL, and old enough to enter a contract where you live.

The service

VESTAL is an iPhone app that helps you keep up with the people you said matter to you. You add people, set how often you want to be in touch, and write down why they matter. The app tracks how long it has been, surfaces a small daily stack of who to reach out to, quotes your own stated reason back to you, and hands you a drafted message or a plan you can act on. It is a personal accountability tool. It does not send anything on your behalf, and it does not contact anyone for you.

Subscription, billing, and cancellation

VESTAL is a paid subscription. There is no free tier and no advertising.

• Price: $5.99 per month or $39.99 per year, in US dollars. Prices in other regions are set by Apple's pricing tiers.
• Free trial: new subscribers get one month free. If you cancel before the trial ends, you are not charged.
• Auto renewal: the subscription renews automatically at the end of each period until you cancel. Your Apple Account is charged when the renewal is confirmed.
• Billing: all payments are handled by Apple through your Apple Account. We never see your payment details.
• Cancelling: cancel any time in your Apple Account settings, at least 24 hours before the current period ends. Deleting the app does not cancel a subscription, and neither does deleting your VESTAL account.
• Price changes: if the price changes, Apple notifies you through the App Store and asks for your consent before the new price applies to a renewal.

Refunds are handled by Apple under the App Store's terms, not by us. If something went wrong, email us anyway and we will help where we can.

Your content

Everything you write in VESTAL is yours. The names, aspirations, notes, dates, topics, and plans you enter stay your property. You give us only the permission we need to run the service for you: to store your content, sync it between our server and your devices, back it up, and display it back to you inside the app. Nothing broader. We do not publish it, sell it, share it for advertising, or use it to train AI models. That permission ends when you delete your account or the content.

You are responsible for what you write, including notes that describe other people. Only record what you would be comfortable having written down.

Acceptable use

Use VESTAL lawfully and for its purpose. Do not:

• use it to harass, stalk, threaten, or surveil anyone;
• break the law or anyone's rights with it;
• reverse engineer, decompile, or tamper with the app, or try to access accounts, data, or systems that are not yours;
• attack, overload, scrape, or otherwise abuse the service or its infrastructure;
• resell, sublicense, or share your subscription access.

We grant you a personal, non-transferable, non-exclusive license to use VESTAL on devices you own or control, for as long as these terms are in effect.

Third party services

VESTAL can hand you a link into booking services such as Resy and GolfNow, and it can open Apple Maps and Apple's message composer. Those are independent companies and their products are not ours. Links are provided for convenience only. We have no affiliation with, control over, or endorsement of any of them, we are not responsible for their content, availability, pricing, or conduct, and anything you do there is governed by their terms and their privacy policies, not ours.

No professional advice

VESTAL is not therapy, counseling, medical care, or any other kind of professional advice, and it is not a substitute for them. Its prompts and drafts are suggestions. Your relationships and your decisions are yours.

Disclaimer of warranties

VESTAL is provided as is and as available, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the app will be uninterrupted, timely, error free, or that every reminder, draft, or notification will be delivered. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Perche Creek Studios, LLC and its members are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, or damage to relationships, arising out of or related to your use of VESTAL, even if we were told such damages were possible. Our total liability for all claims relating to VESTAL is limited to the amount you actually paid us, or paid through Apple for VESTAL, in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.

Termination

You can stop using VESTAL at any time. Delete your account in Settings to erase your data from our server, and cancel your subscription in your Apple Account settings to stop billing. We may suspend or end your access if you materially breach these terms, use the service unlawfully, or put the service or other users at risk. If we ever discontinue VESTAL, we will give reasonable notice in the app so you can export or record what you need.

Governing law

These terms are governed by the laws of the State of Missouri, USA, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Boone County, Missouri, and you and we consent to the jurisdiction of those courts. Nothing here limits any rights you have under the consumer laws of your own country or state.

Changes to these terms

We may update these terms. The effective date at the top of this page changes when we do. If a change is material, we will tell you in the app before it takes effect. Continuing to use VESTAL after a change means you accept the updated terms.

Apple

VESTAL is distributed through Apple's App Store. Apple is not a party to these terms and is not responsible for the app or its content. Apple has no obligation to provide support for VESTAL. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, to the extent Apple's terms allow.

Miscellaneous

If a provision of these terms is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. These terms, together with the Privacy Policy, are the whole agreement between you and us about VESTAL. You may not transfer these terms without our consent. We may transfer them as part of a sale or reorganization of the business.
