Terms of Service

Effective August 28, 2026

These terms are the agreement between you and Perche Creek Studios, LLC, a Missouri limited liability company, for the use of VESTAL.

Accepting these terms

By downloading, opening, or using VESTAL, you agree to these terms. If you do not agree, do not use the app. You must be at least 18 years old to create an account or purchase a subscription, and we do not offer accounts to anyone under 18.

The service

VESTAL is an iPhone app that helps you keep up with the people you said matter to you. You add people, set how often you want to be in touch, and write down why they matter. The app tracks how long it has been, surfaces a small daily stack of who to reach out to, quotes your own stated reason back to you, and hands you a drafted message or a plan you can act on. It is a personal accountability tool. It does not send anything on your behalf, and it does not contact anyone for you.

Subscription, billing, and cancellation

VESTAL is free for up to 3 people. VESTAL Pro is a paid subscription that adds unlimited people and the Met tab. There is no advertising. VESTAL is currently available in the App Store in the United States, Canada, Australia, and New Zealand. We may add other regions later.

Refunds are handled by Apple under the App Store's terms, not by us. If something went wrong, email us anyway and we will help where we can.

Your content

Everything you write in VESTAL is yours. The names, aspirations, notes, dates, topics, and plans you enter stay your property. You give us only the permission we need to run the service for you: to store that content, sync it between our server and your devices, back it up, and display it back to you inside the app. Nothing broader. We do not publish it, sell it, share it for advertising, or use it to train AI models. That permission ends when you delete your account or the content.

What syncs to our server is only what you typed or chose in the app: the names or labels you give the people you add, the reasons you wrote for why they matter, the cadence you set for each person, your notes, the dates you record, your reach-out history, meaning who you reached out to and when, and the rest of the app content listed in the Privacy Policy.

Some things never leave your device and are never sent to us. Your address book, including phone numbers, email addresses, contact identifiers, and contact photos. The contents of your calendar, including your events, their titles, times, and attendees. And the text of any message you send. VESTAL hands a draft to Apple's message composer, and the composer tells the app only whether the message was sent. The words never reach us.

You are responsible for what you write, including notes that describe other people. Only record what you would be comfortable having written down.

Acceptable use

Use VESTAL lawfully and for its purpose. Do not:

We grant you a personal, non-transferable, non-exclusive license to use VESTAL on devices you own or control, for as long as these terms are in effect. That license is subject to the Usage Rules in Apple's Media Services Terms and Conditions, which may permit access through Family Sharing or by an eligible Legacy Contact where those features are enabled.

Third party services

VESTAL can hand you a link into booking services such as Resy and GolfNow, and it can open Apple Maps and Apple's message composer. Those are independent companies and their products are not ours. Links are provided for convenience only. We have no affiliation with, control over, or endorsement of any of them, we are not responsible for their content, availability, pricing, or conduct, and anything you do there is governed by their terms and their privacy policies, not ours. When using VESTAL you must also comply with any applicable third-party terms, such as your wireless carrier's agreement.

No professional advice

VESTAL is not therapy, counseling, medical care, or any other kind of professional advice, and it is not a substitute for them. Its prompts and drafts are suggestions. Your relationships and your decisions are yours.

Disclaimer of warranties

VESTAL is provided as is and as available, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the app will be uninterrupted, timely, error free, or that every reminder, draft, or notification will be delivered. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Perche Creek Studios, LLC and its members are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, or damage to relationships, arising out of or related to your use of VESTAL, even if we were told such damages were possible. Our total liability for all claims relating to VESTAL is limited to the amount you actually paid us, or paid through Apple for VESTAL, in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Perche Creek Studios, LLC and its members from any third party claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or related to what you write or record in VESTAL, including notes you keep about other people; how you use the app, including how you choose to contact anyone through it; your breach of these terms; or your violation of any law or of anyone else's rights, including their rights of privacy and publicity.

We will tell you promptly about any claim we ask you to cover, and we will not settle it in a way that admits fault on your behalf without your consent. You may not settle a claim in a way that admits fault on our behalf, or that obligates us to do or pay anything, without our written consent. We may take over the defense of a claim at our own expense, and if we do, you will cooperate with us. This section does not apply to the extent a claim arises from our own wrongdoing. Some jurisdictions limit or do not allow these obligations, so parts of this section may not apply to you.

Termination

You can stop using VESTAL at any time. Delete your account in Settings to erase your data from our server, and cancel your subscription in your Apple Account settings to stop billing. We may suspend or end your access if you materially breach these terms, use the service unlawfully, or put the service or other users at risk. If we ever discontinue VESTAL, we will give reasonable notice in the app so you can write down what you need.

If we end your access, we erase your data from our server the same way we would if you had deleted your account yourself. Ending your access does not cancel your subscription, because only Apple can do that. Cancel in your Apple Account settings so you are not billed again. If we ended your access for one of the reasons above, we do not refund the rest of a period you already paid for. If we ended it for any other reason, or we discontinued VESTAL, email us and we will support a refund request with Apple for the time you paid for and did not get. Apple makes the final refund decision, as it does for every App Store purchase.

Governing law

These terms are governed by the laws of the State of Missouri, USA, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Boone County, Missouri, and you and we consent to the jurisdiction of those courts. Nothing here limits any rights you have under the consumer laws of your own country or state.

Changes to these terms

We may update these terms. The effective date at the top of this page changes when we do. If a change is material, we will tell you in the app before it takes effect. Continuing to use VESTAL after a change means you accept the updated terms.

Apple

VESTAL is distributed through Apple's App Store. Apple is not a party to these terms and is not responsible for the app or its content.

We are solely responsible for providing maintenance and support for VESTAL. Apple has no obligation to provide any maintenance or support for it.

If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.

We, not Apple, are responsible for addressing any claim you or a third party make relating to VESTAL or to your possession or use of it. That includes product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection or similar law.

If a third party claims that VESTAL, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third party beneficiaries of these terms. When you accept these terms, Apple has the right to enforce them against you as a third party beneficiary.

Miscellaneous

If a provision of these terms is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. These terms, together with the Privacy Policy, are the whole agreement between you and us about VESTAL. You may not transfer these terms without our consent. We may transfer them as part of a sale or reorganization of the business.
